Microcaptive Pre-Trial Penalty Assessment Is Lawful, Judge Finds

A statute requiring microcaptive insurance providers accused of promoting abusive tax shelters to pay 15% of an assessed penalty before securing a jury trial doesn’t violate the Constitution, a Pennsylvania federal district court said.
